I write to alert you to dangerous developments threatening the rule of law in Sri Lanka.<\/strong><\/p>\nDespite considerable efforts by Sri Lanka’s Attorney General and Attorney General’s Department to maintain independence, the current government is exerting unprecedented political pressure on the Attorney General’s Department. This represents a systematic attempt to eliminate the independence of the judiciary and politicize law enforcement mechanisms.<\/p>\n
The government’s conduct reveals a disturbing pattern. When the Attorney General demonstrated cooperation with the government\u2014at times showing bias favorable to their positions\u2014the administration maintained cordial relations. However, as he has refused to accommodate the government’s ever- rising wave of suppression and anti- democratic acts, the government has shifted to systematically attempting to remove him from office. This is retaliation against an independent officer who can no longer cooperate with actions that violate the rule of law.<\/p>\n
Credible reports indicate the government is actively attempting to remove the Attorney General\u2014apparently to serve the interests of corrupt leaders of the government seeking to avoid accountability and legal scrutiny.<\/p>\n
This conduct is fundamentally undemocratic and against the practice of democracy. The government has demonstrated a pattern which suppresses voices of Opposition Members critical of the government through legal intimidation, weaponizing state institutions against those who resist their authority, and creating a climate of fear within the legal profession.<\/p>\n
These actions reflect a Marxist practice of the government by undermining democracy\u2014centralizing executive power while dismantling institutional checks and balances essential to constitutional governance. The incumbent government has instituted an unprecedented practice of according preferential treatment in matters of judicial appointments, promotions, and disciplinary proceedings to members of the judiciary who demonstrate favorable dispositions toward the current practices of suppression of the government.<\/p>\n
1 respectfully request that your government\/organization raise these concerns with Sri Lankan authorities and emphasize that attempts to remove constitutional officers for taking independent legal positions represent undemocratic practices incompatible with the rule of law. The international community cannot remain silent while Sri Lanka systematically undermines judicial independence and targets those who refuse to facilitate their anti- democratic agenda.<\/p>\n

I would like to draw your attention to a matter of grave concern regarding democratic governance in Sri Lanka.<\/p>\n
For over one year, the Sri Lankan government has failed to appoint a full-time Auditor General. For approximately one month, the country has had no Auditor General whatsoever\u2014neither permanent nor acting.<\/p>\n
This vacancy directly undermines parliamentary financial oversight exercised through the Committee on Public Accounts (COPA) and Committee on Public Enterprises (COPE). Without an Auditor General, corruption controls are effectively disabled\u2014serving the interests of corrupt leaders of the government who seek to avoid scrutiny.<\/p>\n
Most alarmingly, against the stance of the Constitutional Council and overlooking qualified persons already in line for the appointment, the government has refused to appoint a suitable officer to the post. This reveals a deliberate strategy to either install a politically compliant appointee or maintain institutional paralysis that prevents independent oversight.<\/p>\n
The deliberate vacancy, despite Constitutional Council guidance and available qualified candidates, is fundamentally undemocratic and against the practice of democracy. This reflects a Marxist practice of the government by undermining democracy\u2014centralizing power while dismantling constitutional checks and balances. The government systematically suppresses voices of Opposition Members critical of the government, particularly regarding financial accountability.<\/p>\n
I respectfully urge you to raise this matter in bilateral discussions with Sri Lankan authorities and emphasize that acting against the Constitutional Council’s stance, overlooking qualified candidates, and systematically obstructing constitutional appointments represents undemocratic practices incompatible with the rule of law. The international community cannot remain silent while Sri Lanka deliberately dismantles financial accountability to serve corrupt interests.<\/p>\n
